ListingWizard.ai ("ListingWizard," "we," "us," or "our") operates the website at listingwizard.ai and the real estate marketing platform available through it (collectively, the "Service"). This Privacy Policy explains what information we collect, how we use it, with whom we share it, and the choices you have. By using the Service you agree to the practices described here.

1. Information We Collect

1.1 Information You Provide

  • Account data — name, email address, phone number, brokerage name, and password when you register.
  • Listing data — property addresses, descriptions, photos, MLS numbers, pricing, and other real estate content you upload or generate.
  • Brand & profile data — headshot, logo, brand colors, and voice-profile samples you configure.
  • Payment data — billing name and address entered during checkout (card numbers are handled directly by Stripe and never reach our servers).
  • Communications — messages you send us via the support form or email.

1.2 Information We Collect Automatically

  • Log data — IP address, browser type and version, pages visited, referring URL, and timestamps.
  • Device data — operating system, screen resolution, and device identifiers.
  • Usage data — features used, actions taken, and session duration within the platform.
  • Cookies and similar technologies — see Section 3 for full details.

1.3 Information from Third Parties

We may receive limited information from advertising and analytics partners (described in Section 4) about how users arrived at our website or interacted with our ads, such as click and conversion data. We do not receive raw personal profiles from these partners.

1.4 Photographs and AI Analysis

How We Process Photographs

When you upload property photographs, we transmit them to OpenAI for automated analysis. This analysis identifies room types, detects property features, assigns a quality score, and generates descriptive captions used to improve AI-generated listing content. Photographs may also be processed by Anthropicfor content generation purposes.

We do not use your photographs or any other User Content to train, fine-tune, or otherwise improve any AI model, whether operated by us or a third party. Our agreements with AI service providers restrict them from using customer API inputs for model training.

Photograph Retention

Uploaded photographs are stored in DigitalOcean Spaces for as long as the associated listing exists in your account. When you delete a listing or close your account, we delete the associated photographs from our storage within 30 days, subject to any legal hold obligations. Copies transmitted to AI processors are subject to those providers' retention policies (typically 30 days or less for API inputs).

Biometric Data Notice

Certain U.S. state laws — including the Illinois Biometric Information Privacy Act (BIPA), Texas Chapter 503, and Washington RCW 19.375 — regulate the collection or extraction of biometric identifiers such as facial geometry from photographs. Our AI analysis is directed at property features, not people. We advise you not to upload photographs containing identifiable individuals (other than your own professional headshot in your profile settings). By uploading photographs you represent that you have obtained any required biometric consents for any person who may be identifiable in the content, or that no such persons appear.

Agent Headshots and Brand Assets

Agent headshots and logo files you upload are stored and displayed as part of your brand profile and on public listing microsites. These assets are not transmitted to external AI services for analysis. You retain full ownership and may delete them at any time from your account settings.

2. How We Use Your Information

  • Provide and improve the Service — generate listing content, process payments, send transactional emails, and develop new features.
  • Personalize your experience — remember your brand preferences and writing style for AI generation.
  • Analyze usage — understand how the Service is used so we can fix bugs and prioritize improvements (analytics cookies only with your consent).
  • Marketing and advertising — measure the effectiveness of our ads, run remarketing campaigns, and show relevant ads to prospective users (marketing cookies only with your consent).
  • Security and fraud prevention — detect and prevent unauthorized access or abuse.
  • Legal compliance — comply with applicable laws and respond to lawful requests from authorities.

Essential Cookies

Set only with your consent. We use Google Analytics 4 to collect anonymized data about how visitors use our website (pages viewed, session duration, traffic source). This data helps us improve the Service. Google Analytics sets cookies such as _ga and _ga_*. Data is transmitted to and stored by Google LLC in the United States.

Marketing and Advertising Cookies

Set only with your consent. We use the following advertising platforms to measure conversions and show relevant ads to people who have visited our website:

  • Google Ads — Google's conversion tracking and remarketing tags collect data about your interaction with our ads and website. Data is processed by Google LLC (US).

4.2 Advertising and Analytics Partners

Subject to your cookie consent, we share certain browsing and conversion event data with Google, Meta, and Microsoft as described in Section 3. Under the CCPA, sharing data with advertising partners for cross-context behavioral advertising may constitute a "sale" or "sharing" of personal information. California residents can opt out as described in Section 7.

4.3 Legal Requirements

We may disclose information if required by law, court order, or government authority, or when we believe disclosure is necessary to protect our rights or the safety of others.

4.4 Business Transfers

If ListingWizard is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you before your information becomes subject to a materially different privacy policy.

4.5 No Sale of Personal Information

We do not sell your personal information to data brokers or third parties for their own marketing purposes.

5. International Data Transfers

ListingWizard is operated from the United States. If you access the Service from outside the US, your information will be transferred to, stored, and processed in the US, where data protection laws may differ from those in your country.

When we or our service providers transfer personal data from the European Economic Area (EEA), the United Kingdom, or Switzerland to the US or other countries, we rely on appropriate safeguards such as the EU Standard Contractual Clauses (SCCs) or other mechanisms recognized under applicable law. Our advertising and analytics partners (Google, Meta, Microsoft) participate in the EU-U.S. Data Privacy Framework or use SCCs for international transfers.

6. Data Retention

We retain account and listing data for as long as your account is active and for a reasonable period thereafter to comply with legal obligations and resolve disputes. Analytics and advertising data retained by third-party platforms is subject to their own retention policies. Cookie consent records are retained for audit purposes for up to five years.

7. Your Rights and Choices

All Users

  • Access and correction — You may review and update your account information at any time from your account settings.
  • Cookie preferences — You may withdraw or update your cookie consent at any time (see Section 3).
  • Marketing emails — You may unsubscribe from promotional emails using the unsubscribe link in any such email.

California Residents (CCPA / CPRA)
